4. Eligibility Requirements

To be eligible for a vehicle service contract from Auto Guard, you must meet the following conditions:

• Own or lease a qualifying vehicle

• You must provide accurate and complete information about your vehicle
• You must be at least 18 years of age

5. Customer Obligations

As a customer of Auto Guard, you agree to:

6. SMS Communication Terms

By providing your mobile number and opting in, you consent to receive text messages from Auto Guard. The following terms apply:

• Message Frequency: Up to 10 messages per month
• Costs: Message and data rates may apply from your carrier
• Opt-Out: Reply STOP to any message to cancel SMS communications

• Consent Not Required: Consent to receive SMS messages is not a condition of purchasing any products or services

8. Disclaimer of Warranties

YOUR USE OF OUR WEBSITE AND SERVICES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT AS EXPRESSLY PROVIDED IN YOUR VEHICLE SERVICE CONTRACT, AUTO GUARD DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9. Claims Process

All claims must be submitted in accordance with your specific vehicle service contract. The standard claims process includes:

1. Contact Auto Guard to report the issue
2. Take your vehicle to an authorized repair facility
3. Provide all required documentation
4. Wait for claim approval before proceeding with repairs
5. Pay applicable deductible

Failure to follow the claims process may result in denial of coverage.

10. Cancellation and Refunds

You may cancel your vehicle service contract at any time. Refund eligibility depends on the cancellation period and the terms of your specific policy:

• 30-Day Money-Back Guarantee: Full refund if canceled within 30 days of purchase, provided no claims have been filed
• After 30 Days: Refund calculated on a pro-rata basis minus applicable fees
• After Claim: Reduced or no refund depending on claim amount

Auto Guard reserves the right to cancel your contract for non-payment, fraud, material misrepresentation, or violation of policy terms.

11. Intellectual Property

All content, materials, logos, trademarks, and intellectual property on our website are owned by Auto Guard Solutions LLC or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

12. Prohibited Conduct

When using our website or services, you agree NOT to:

• Submit fraudulent claims or misrepresent facts
• Attempt to gain unauthorized access to our systems

Any dispute arising from these Terms or your use of our services shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Delaware.

You agree to bring any claims against Auto Guard within one (1) year of the event giving rise to the claim, or such claim shall be permanently barred.

15. Indemnification

You agree to indemnify, defend, and hold harmless Auto Guard Solutions LLC and our officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use of our services.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of our services after any changes constitutes your acceptance of the modified Terms. We will notify you of material changes via email or through a notice on our website.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with your Vehicle Service Contract (if applicable) and our Privacy Policy, constitute the entire agreement between you and Auto Guard regarding your use of our website and services.
